Am For Prosperity et al v. St Of Colo et al: Repeal the Gas Tax

This lawsuit was filed to hold the Colorado legislature accountable for following voters’ will when they passed Proposition 117 in 2020. Prop 117 requires the state to get voter approval before passing a fee increase past a certain amount – which is one way the legislature attempts to get around Colorado’s TABOR requirement that the state ask voters before raising taxes. Despite Prop 117’s clear requirements, the legislature passed a fee increase on gas, ride shares, and deliveries, all without voter approval. This lawsuit seeks to stop the legislature’s blatant overreach.
